The process for a foreigner to have a court marriage in Nepal is a bit more involved than for Nepali citizens, but it is a well-established legal procedure. The process is regulated by Nepal's National Civil (Code) Act of 2017.

Here is a step-by-step breakdown of the process and the required documents:

 

Eligibility Criteria

 

Before you start, you and your partner must meet the following conditions:

  • Age: Both individuals must be at least 20 years old.

  • Marital Status: Both parties must be unmarried, or legally divorced if they were previously married.

  • Mutual Consent: Both individuals must freely and mutually agree to the marriage.

  • No Prohibited Relationship: The couple must not be closely related as defined by Nepalese law.

  • Residency: The foreign national must have been residing in Nepal for a continuous period of at least 15 days before applying for the marriage.

 

Required Documents

 

Gathering the correct documents is the most crucial part of the process. For a foreign national, these include:

  1. Passport and Visa: A notarized copy of your passport with a valid Nepali visa. The visa must show your legal entry into Nepal.

  2. No Objection Letter / Single Status Certificate: This is a letter from your country's embassy or consulate in Nepal stating that you are single and there are no legal impediments to your marriage. If your country does not have an embassy in Nepal, you will need a notarized "Single Status" document from a relevant government authority in your home country.

  3. Proof of 15-day Residency: A letter from the local Ward Office (ward office of your residence in Nepal) confirming that you have resided in that specific location for at least 15 continuous days. This is a mandatory requirement.

  4. Marriage Law of Your Country: A notarized translation of your home country's marriage law into the Nepali language. This document confirms that your marriage in Nepal will be legally recognized in your country of origin.

  5. Passport-Sized Photographs: Four recent passport-sized photos of both individuals.

  6. Divorce Decree (if applicable): If you were previously married, you must provide the original or a notarized copy of your divorce decree or the death certificate of your former spouse.

  7. Witnesses: You need at least two witnesses (one for each party). They must be present at the court hearing and provide a copy of their Nepali citizenship certificate.

Koseki (戸籍謄本)

The Koseki (戸籍), or family registry, is Japan's official record of a person's family relationships, including birth, marriage, divorce, and death. It's a fundamental document for Japanese citizens, proving their identity and nationality.

Important Note for Non-Japanese Residents:

A Koseki is exclusively for Japanese citizens. If you are not a Japanese national, you will not have a Koseki or be able to obtain one.

For Japanese citizens marrying in Nepal, a key document you'll need is NOC letter. This certificate, issued by the Embassy of Japan in Nepal, officially states that you are legally free to marry under Japanese law. It's a vital piece of paperwork for your Nepali court marriage.

Here are the key points:

  • You should not go directly. The embassy has an appointment system in place.

  • Book by email:Please send an email to the consular section to schedule an appointment. The email address is consular-emb@km.mofa.go.jp.

  • Provide information: In your email, it would be wise to state your purpose (obtaining a certificate of eligibility to marry), your full name, and your contact details. This will help them process your request more efficiently.

  • Enter your full Japan address while applying.
